Terms & Conditions

 


1. Promotion

Subject to these Terms and Conditions, eBay agrees to provide Eligible Business Sellers’ with a total of £500 to offset against their eBay fees for successful participation in and completion of the Scheme (the “Promotion”).  


2. Kickstart Scheme

The Kickstart Scheme (the “Scheme”) was announced in July as part of the Chancellor’s Plan for Jobs. The Scheme aims to create thousands of high-quality six-month job placements for young people aged 16 to 24 who are claiming Universal Credit and are at risk of long-term unemployment.

Under the Scheme, the Government will cover 100 per cent of employment costs for 25 hours a week. This includes the employee's salary at the appropriate minimum wage for their age, as well as National Insurance and pension contributions.

3. Eligibility

This Promotion is open to eBay Business Sellers who meet all of the following criteria (“Eligible Business Sellers”):

  1. a UK-based business with a registered address in the UK;
  2. are not currently, or have not previously, participated in the Scheme;
  3. wish to participate in the Scheme by offering under 30 job placements;
  4. iv. are within the first 1,000 eBay Business Sellers to apply to participate in the Scheme via the FSB website here between: (a) 00:00:01 on 9 December 2020; and (b) 23:59:59 on 8 December 2021 or the successful application of 1,000 eBay Business Sellers to the Scheme (whichever is earliest) (the “Application Period”); and
  5. are deemed eligible for and accepted into the Scheme by FSB, AWV (see below) and the Department of Work and Pensions in accordance with the conditions set out by the Government (see further information on eligibility criteria here).

Participation is linked to each Business Seller and is not transferable. Further, you can only participate in the Promotion once irrespective of your number of eBay accounts.

 

4. Promotion and Procedure

  • All aspects of the Scheme (such as eligibility, application process, participation, and support) will be co-ordinated, provided and managed by FSB and/or FSB partners (Adecco Working Ventures “AWV”).

  • eBay will not be involved in or have any responsibility for any aspects of the Scheme, including your participation in the Scheme.

  • Business Sellers who wish to participate in the Promotion are required to apply for the Scheme via the FSB website here during the Application Period. The application process, selection and contacting of successful entrants will be managed by FSB and/or AWV.

  • AWV will confirm the number of Eligible Business Sellers participating in the Scheme to eBay following the expiry of the Application Period. This confirmation will also include the name and eBay ID of each Eligible Business Seller.                    

  • Eligible Business Sellers will enter into terms and conditions directly with AWV regarding your participation in the Scheme.

  • AWV will assess the Eligible Business Sellers’ participation and performance in the Scheme according to its criteria and assessment processes set out in the terms and conditions of the Scheme. Successful participation in and completion of the Scheme will be decided by AWV accordingly.

  • Upon confirmation by AWV to eBay of your successful participation in the Scheme for a period of 3 months (defined as 3 months from the employment start date of the job placement), eBay will credit you £250 accordingly in the next billing cycle following such confirmation.

  • Upon confirmation by AWV to eBay that you have successfully completed the Scheme after the end of the 6 month job placement, eBay will credit you a further £250 accordingly in the next billing cycle following such confirmation.

  • The maximum credit provided to any Eligible Business Seller by eBay will be £500. The offering of more than one job placement in the Scheme or any future job placements will not give rise to any increase or further payments.
 

5. Restrictions and exclusions

The following are excluded from the Promotion:

  • Private sellers.

  • Business Sellers who are currently participating (or have previously participated) in the Scheme.

  • Business Sellers who sign up to the Scheme via avenues other than the FSB website here, or apply outside the Application Period.
 

6. General

Any attempt to manipulate the Promotion is prohibited and will result in exclusion from participation.

The Promotion is only open to Eligible Business Sellers. Any users who attempt to circumvent this will be removed from the Promotion, be liable for any fees credited to or not paid by them under the Promotion and may face additional sanctions in accordance with the eBay User Agreement.
 
eBay reserves the right to suspend, change or cancel the Promotion at any time, in the event of circumstances arising which, in eBay's opinion, make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of the Promotion.
 
eBay also reserves the right to exclude users on the basis that their seller accounts have fallen below the minimum required
seller performance standards or for any reason in eBay’s absolute discretion. Business Sellers should confirm eligibility by checking their account status on My eBay.
 
The decision of eBay regarding any aspect of the Promotion is final and no correspondence will be entered into.
 
All eligibility for this Promotion will be determined by AWV and the Department of Work and Pensions in accordance with the conditions set out by the Government. eBay reserves the right to verify your eligibility for this Promotion.
 
eBay may also disqualify any entrant who does not act in accordance with these Terms and Conditions (or is acting in a way which contravenes the  spirit  and intention of these Terms and Conditions) or eBay's
User Agreement, and/or any policies that eBay may communicate to you.
 
These Terms and Conditions are governed by the laws of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these Terms and Conditions.

Unless the context otherwise requires, words in the singular in these Terms and Conditions shall include the plural and in the plural include the singular.


7. Limitation of liability

eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any Promotion.
 
eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant or any third party resulting directly or indirectly from entry to this Promotion or the Scheme. Nothing in these terms shall limit eBay's liability for death or personal injury resulting from negligence or fraud.
 
eBay will not be responsible for any third party's performance or failure to perform any services related to any Promotion or the Scheme, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion or the Scheme, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.
 
eBay does not accept, and is not responsible for, any lost, or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion. Further, eBay does not accept, and is not responsible for any rejected entries to the Promotion or the Scheme. The application process for the Promotion (and the Scheme) is managed by FSB and/or AWV, acceptance is at FSB and/or AWV’s discretion.
 
Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotion Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion or the Site, including without limitation the accuracy of any Promotion Material. Further, eBay is not responsible for any information relating to the Scheme or the Promotion provided by third parties, regardless of whether such third-party information is referred in or linked to in these Terms and Conditions.
